Forming an LLC in New Hampshire in 7 easy steps

  1. Pick a name for the LLC. The name must be unique (not used by another LLC) and you must adhere to trademark law. The name must also contain an LLC identifier, e.g. “Limited Liability Company”, “Ltd Liability Co” or “LLC”.
  2. New Hampshire law does not force you to hire an attorney when forming an LLC. It is however advisable to let an attorney check the Operating Agreement for the LLC, because faulty agreements are known to cause tax problems for LLC’s. Paying an attorney now can save the LLC and its members a lot of money and trouble in the long run.
  3. Go to the state filing office in New Hampshire and file your Articles of Organization. The minimum LLC filing fee in New Hampshire is $100. (For 60 business days.)
  4. You must now have an Organizational Meeting where the members of the limited liability company adopt the Operating Agreement.
  5. Your LLC is now eligible for a Federal Employer Identification Number (FEIN).
  6. You can now open up a company bank account.
  7. Last but not least, apply for local business licenses and any required permits from applicable cities and counties.
